How to keep your business safe from legionella: 

JLA know that keeping your business safe from legionella is a legal requirement and that you have a legal obligation to carry out a legionella risk assessment of the water services in your business. That's why we have designed our heating equipment with you in mind.  

The legal requirement for carrying out a legionella risk assessment is defined under the following legislation:

1. The Health and Safety at Work Act 1974

You or the person responsible for managing risks, need to understand your water systems, the equipment associated with the system such as pumps, heat exchangers, showers etc, and its constituent parts. Identify whether they are likely to create a risk from exposure to legionella as well as understanding your current system and how it works.

2. Management of Health and Safety at Work Regulations 1999

The law states that a duty holder is required to appoint a responsible person who assumes day-to-day managerial responsibility to complete a legionella risk asssessment. However, external support can be enlisted (duty holder must make reasonable checks to ensure competence of person appointed).

3. Control of Substances Hazardous to Health Regulations 2002 (COSHH)

The law states that the following steps must be taken to prevent the outbreak of Legionella.

  • Identify sources of legionella 
  • Define measures necessary to prevent exposure (i.e. eliminate)     
  • If not reasonably practicable – define the means of control.
4. HSG 274 (Healthcare specific - HTM 04-01)

As an employer, you have a responsibility to ensure the correct health and safety precautions are taken to reduce the risks of exposure to legionella. You must understand how to:

  • Identify and assess sources of risk
  • Manage any risks
  • Prevent or control any risks
  • Keep and maintain the correct records
  • Carry out any other duties you may have

Failure to comply with the relevant legislations can lead to prosecution, even if an outbreak hasn’t actually occurred. If a water system poses a risk, a suitable risk assessment has not been carried out, or the necessary monitoring/precautions have not been taken in accordance with the approved code of practice then prosecution may occur.

Legionella risk assessments should detail in depth how your company is taking steps to ensure all risks from legionanaires’ disease and legionella has been managed to protect people as much as possible.

Frequency of Risk Assessments:

Legionella risk assessments should be carried out regularly in order to ensure outbreaks are prevented. The risk assessments should be reviewed at the following stages: 
Legally - Every two years
Legally - If there has been any significant changes to the water system 
Best Practice - As frequently as possible to ensure water is safe for use 

Procedures that can be implemented to prevent legionella:

To ensure legionella is prevented as well as possible, measures should be implemented, these could include:

  • Cleaning and Disinfection routines  
  • Temperature control
  • Temperature monitoring
  • Taking water samples and checking for legionella bacteria
